The duty to manage asbestos applies to non-domestic premises, and to the common or shared parts of residential blocks — not to individual private homes. Under Regulation 4 of the Control of Asbestos Regulations 2012, The dutyholder (whoever is responsible for maintenance and repair) must find or presume the asbestos, assess and record its condition, plan how to manage it, and tell anyone who could disturb it.
