The duty to manage asbestos applies to non-domestic premises, and to the common or shared parts of residential blocks — not to individual private homes. Under Regulation 4 of the Control of Asbestos Regulations 2012, The dutyholder (whoever is responsible for maintenance and repair) must find or presume the asbestos, assess and record its condition, plan how to manage it, and tell anyone who could disturb it. This applies to commercial premises, rented housing and public buildings across Cheshire.
In Cheshire the rules differ by area. Cheshire East accepts bonded asbestos (up to six sheets) at its Crewe and Macclesfield sites, but only by appointment, double-wrapped in heavy-duty polythene. Cheshire West and Chester does not accept asbestos at any recycling centre and directs residents to a licensed removal company. Always double-wrap and seal, and confirm with your council first.
